European Patent Litigation Certificate – the Preparatory Committee’s proposal

IMG_8533-1As highlighted in our post earlier this week the Preparatory Committee’s proposal for the rules for the European Patent Litigation Certificate were agreed at its early September meeting. These rules have now been published (here) along with an Explanatory memo (here). IPcopy has generated a tracked changes version of the latest proposal showing the changes to the rules since the consultation document (tracked changes document here).

As noted below (and in CIPA’s note sent yesterday to the profession) the proposal as agreed by the Preparatory Committee represents a great deal for the UK patent profession and a huge pat on the back is due to those at CIPA, the UKIPO and elsewhere for their efforts on this front. Based on some of the responses received to the consultation IPcopy can only presume that the CCBE and the IPLA aren’t quite so enamoured with the proposal…..hey ho. (more…)

UPC Court Fees Consultation launches 8 May 2015

IMG_8533-1The UPC Preparatory Committee met this week on 5 May (Turbo Tuesday) and the big piece of news from the meeting is that the consultation document in respect of for the court fees and recoverable costs for the Unified Patent Court is ready to launch. The written consultation will run from tomorrow 8 May 2015 for 12 weeks. This means that from tomorrow we should hopefully have some idea what the fee amounts in Rule 370 of the Rules of Procedure (see page 149-150) will look like. (more…)

European Patent Litigation Certificate – Response to Consultation

Unified patent courtThe Legal Working Group of the Preparatory Committee has recently launched a consultation on their proposals for the European Patent Litigation Certificate. The consultation timeframe is relatively short and runs until Friday 25 July 2014. Comments are to submitted electronically to secretariat@unified-patent-court.org. The consultation document can be found here and an explanatory memorandum can be found here.

At a recent CIPA seminar The Hon Mr Justice Birss suggested that the best way to influence the Prep Committee’s position on the content and form of the EPLC would be to present a united front with other countries in Europe. To that end IPcopy would be interested to hear from readers in other countries, e.g. Ireland, Sweden, the Netherlands, regarding their reaction to the content of the EPLC proposal. Additionally if any reader wants to share their response to the consultation then IPcopy will be happy to start a consultation round-up post.

European Patent Litigation Certificate – CIPA’s Public Consultation Seminar

Unified patent courtArticle 48(2) of the Agreement on the Unified Patent Court (which relates to representation) states: “Parties may alternatively be represented by European Patent Attorneys who are entitled to act as professional repre­sentatives before the European Patent Office pursuant to Article 134 of the EPC and who have appropriate qualifications such as a European Patent Litigation Certificate“.

What constitutes a European Patent Litigation Certificate has been the subject of much discussion already (here’s an earlier IPcopy article) and is now the subject of a formal consultation (details here) with a closing date of 25 July.

Consultation Craziness

GB+EU flagNot one, not two but three different patent related consultations have popped up in the last week or so, relating variously to the implementation of the Intellectual Property Act 2014, the implementation of the Unified Patent Court in the UK and the European Patent Litigation Certificate (required for European Patent Attorneys to have the right to represent clients in the Unified Patent Court).

The various consultations, their deadlines and a brief overview of each consultation are noted below. We’ll try and chime in with some more detailed thoughts in follow up posts. (more…)
